Welcome to Cre8tive Real Estate. These Terms and Conditions (“Terms”) govern your access to and use of the website CreativeHomeSelling.com (the “Site”) and the services provided by Cre8tive Real Estate (“we”, “us”, “our”). By accessing or using the Site, you (“you”, “User”, “Seller”, or “Buyer” as applicable) agree to these Terms.
1. Definitions
“Buyer” means a user who is seeking to purchase or invest in a property via the Site’s listing services.
“Seller” means a user who lists a property on the Site and offers it through creative financing, lease-option, or similar terms.
“Listing” means a property listing posted by a Seller via the Site’s platform.
“Services” means the functionality the Site offers that connects Sellers and Buyers, including account creation, property listing tools, search filters, direct contact, dashboard/lead-management features.
“Transaction” means any agreement, deal, or contract between Seller and Buyer arising out of a Listing — and which takes place outside the Site.
2. Role of the Site
The Site focuses on properties offered through creative real estate solutions, including seller financing, subject-to existing loan, wraparound, hybrid, and rent-to-own structures.
The Site acts solely as a platform connecting Sellers and Buyers. We do not act as an agent, broker, escrow, lender, or any party to Transactions (unless explicitly stated).
All Transactions occur directly between Seller and Buyer, outside the Site. We do not guarantee performance by any party, nor do we provide financial or legal advice.
We do not verify, endorse, or guarantee the accuracy of any Listing or the legitimacy of any Seller or Buyer. You are solely responsible for performing your own due diligence, inspections, and legal review before entering into any agreement.
You understand and agree that you act at your own risk in any Transaction, and we expressly disclaim any liability for actions or omissions by Sellers or Buyers.
3. Eligibility & Account Registration
You must be at least 18 years old and capable of entering into binding agreements in your jurisdiction to register.
When you register, you must provide true, accurate, and current information and maintain it. You may not allow others to use your account.
By providing contact information, you consent to receive communications related to your listings or inquiries, including emails or WhatsApp messages from interested users.
We reserve the right to verify, suspend, or cancel any account at our discretion (including through manual review or verification processes).
4. Listings, Buyer Inquiries & Dashboard
Sellers are fully responsible for the accuracy and completeness of their Listings, including descriptions, terms, photos, deal-structure disclosures, and compliance with applicable laws.
Buyers are responsible for verifying all Listing details, performing due diligence, and entering any Transaction at their own risk.
We provide a dashboard and lead-management area for Sellers to manage inquiries, leads, and analytics. Use of the dashboard is subject to these Terms.
5. User Conduct
You agree not to do any of the following:
• Post false, misleading, fraudulent, or illegal Listings or content;
• Use the Site to solicit or advertise services outside the scope of the platform without authorization;
• Interfere with other users’ use of the Site;
• Circumvent Site fees, policies, or violate rights of others (including intellectual property, privacy, or contractual rights).
Violation may result in account suspension, termination, and legal remedies.
6. Fees & Payments
The Site may offer free registration and basic listing tools, but we reserve the right to charge fees for premium features, enhanced listings, dashboard tools, or memberships.
Sellers and Buyers acknowledge that all Transactions and payments between them are independent of us. We do not receive, hold, or process payments for property transactions unless explicitly stated.
Unless otherwise agreed, fees for platform services are non-refundable.
We will notify users in advance of any changes to fee structures or introduction of paid plans.
7. Disclaimers, Limitation of Liability & Indemnity
The Site and Services are provided “as is” and “as available,” without warranty of any kind, either express or implied.
We are not responsible for any Transaction, performance, or conduct of Sellers or Buyers.
In no event will we be liable for indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the Site or any Transaction.
You agree to indemnify, defend, and hold harmless Cre8tive Real Estate, its affiliates, officers, directors, employees, and agents from any claim, liability, or damage (including legal fees) resulting from your use of the Site, your breach of these Terms, or any Transaction you enter.
8. Intellectual Property
All content on the Site (text, graphics, logos, design, software) is owned or licensed by us, unless otherwise stated.
You may not reproduce, modify, or distribute Site content without prior written consent.
9. Termination & Suspension
We may suspend or terminate your account or access to the Site at any time for any reason (including suspected misconduct) with or without notice.
On termination, your license to use the Services ends and you must cease all use of the Site’s tools.
Clauses which by nature continue after termination (e.g., Indemnity, Limitation of Liability, Intellectual Property) survive termination.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws provisions.
You consent to exclusive jurisdiction and venue in the state and federal courts located in Texas.
If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue in full force.
11. Disclaimer of Brokerage Relationship
Cre8tive Real Estate and CreativeHomeSelling.com are not real estate brokers, agents, or lenders. We do not represent buyers or sellers in any transaction, collect commissions, or provide brokerage services. All communications and agreements between users occur independently of the platform.
12. Changes to Terms
We may revise these Terms at any time. We will post the updated Terms on the Site and update the “Last Updated” date below.
Your continued use of the Site after changes constitutes your acceptance of the new Terms.
